Here is the newspaper article regarding the case.

A Rock Island man charged with murdering Larrion Wellington last summer in Rock Island claims police ignored him when he invoked his right to remain silent.

Darryl Bernard Shears Jr., 25, said Rock Island police denied him his constitutional right when they interviewed him at the Davenport Police Department following his arrest. During the interview Shears allegedly told police that he shot Wellington because he and others were making fun of him.

Shears has pleaded not guilty to the murder count he faces in Rock Island County Circuit Court. He is accused of shooting Wellington on June 22.

Judge Walter Braud is expected to rule on Shears’ motion to suppress the statement before the trial starts on Jan. 12. Shears is being represented by Rock Island attorney Daniel Dalton.

Davenport officers arrested Shears one day after the shooting. He and three others were involved in a high-speed chase with police before they crashed at Warren Street and Central Park Avenue.

Wellington, 22, also of Davenport, was among a group of people at 5th Street and 15th Avenue in Rock Island around midnight June 22 when Shears yelled something out the window of his passing car, police have said.

When Shears pulled over and walked back to the crowd, everyone fled, except for Wellington, police said, adding he was shot in the abdomen at close range.

Several witnesses identified Shears as the shooter, police said. Shears told police he was high on the drug Ecstasy at the time and became agitated when the group that included Wellington made fun of him for his intoxicated stagger.

Wellington died at a local hospital the morning after the shooting.

Earlier this month a defendant in a Davenport murder case successfully argued that his statements to police should be suppressed for similar

reasons.

Oliver Litt Jr., 35, of Davenport, successfully argued that police violated his right to an attorney and to consult his girlfriend during an interview at the Davenport police station one week after the fatal shooting of Hano Bailey, 41, of Davenport.

Bailey was shot May 22 at the Davenport International House of Pancakes.

Litt’s co-defendant, Alfred Demond Brown, had his motion to suppress search warrants and statements he made to police denied.
