Cemetery notes and/or description:\nLocated on Highway 84 in the Whatley Community in Clarke County Alabama. \n\nThe land the family burial ground/cemetery is situated on what was the land of Edwin and Mary Johns Davis. \n\nEdwin Davis gave the land to Frederick Davis, his 9 year old son by his wife Mary Elizabeth Johns in a deed of gift being he was going to Virginia and mentioned the possibility of his not returning on Feb. 1, 1847. Frederick\'s mother was allowed to live there until Frederick Davis reached the age of 21 to raise Edwin\'s children. Edwin Davis is shown on the 1850 Clarke Co. AL Federal Census with Mary Elizabeth Johns Davis and his children.\n\nFrederick Davis died Aug 12, 1862 in Mobile, AL while serving for the Confederate Army and was returned via the steamer \"The Duke\" to be buried on the family land. \nFrederick\'s mother Mary E. Johns Davis continued living on the property the burial ground/cemetery is on belonging to Frederick until her death thought to be Sept. 1868 when John B. Davis, son of Mary Johns Davis filed to settle the estate of Frederick Davis Sept. 20, 1868.\n\nLem Whatley son of Franklin B. & Martha S. Whatley, grandson of Mary Elizabeth Johns Davis is said to be the first burial on the Frederick Davis land he died Mar 24, 1864. It is highly likely that Frederick Davis was buried there first and it is possible that Edwin Davis and Mary Johns Davis are also buried there. \n\nThe land the family burying ground/cemetery is on was sold at auction 25th day of July AD 1871 to settle the estate of Frederick Davis. Martha S. Whatley wife of Franklin Benjamin Whatley, half brother of Frederick Davis purchased the land for $125.00.\n\nOld maps show the cemetery as the Davis Cemetery, not to be confused with the Davis Family Cemetery behind Mr. Garrick\'s grocery store directly across Hwy 84 from The Whatley Family Cemetery that was on Davis land.\n\nThe area did not become a town until the General assembly of Alabama created it. See below. \n\nSection 1 of the 1900-1901 General assembly of Alabama, \"---That the town of Whatley, in Clarke County, Alabama, is hereby created a municipal corporation under the name and style of the town of Whatley ---. Section 2. \"---That the territorial limits of said town of Whatley shall comprise the whole of section 19, township eight (8), range four (4) east.\n\nThe town was named for Franklin Benjamin Whatley son of Mary Elizabeth Johns. His grandfather was Rev. Elder Willis Whatley a descendant of Old Shirley Whatley.\n\nDescription of Cemetery:\n\nCommence at the center of Section 19 run east two hundred and fifty yards (250) thence South thirty nine yards (39) to place of beginning run East thirty seven yards (37) thence north one hundred yards (100) to place of beginning one acre more or less.\n\nThe cemetery was sold for $25.00 by M. W. Whatley 29th of April 1907 to the citizens of the Town of Whatley. \n\nThat we M. W. Whatley and S. C. Whatley wife of M. W. Whatley for and in the consideration of the sum of Twenty Five Dollars to us in hand paid by the Cidersons of Whatley the receipt whereof is hereby acknowledged and we M. W. Whatley and wife have this day bargained, sold and conveyed, and do by these presents bargain, sell and convey to the said Cidersons of the town of Whatley. It is expressly understood that this lot or portion of land is sold and set aside as a town cemetery for the town of Whatley.\n\nThe Old Whatley Family burying ground/cemetery (Whatley Cemetery) that began on Davis land remains active. The front of the cemetery is Whatley and Mary Elizabeth Johns Davis descendants. Many community members are buried in back section of the cemetery.\n\nSource of cemetery description: Deed from Mackie Whatley to the Citerons of the Town of Whatley. Whatley gave up their town charter and is no longer a town. \n
